Soil is an ecosystem and a natural resource of extraordinary value. It is the space in which man develops his life, and plays an irreplaceable role from the economic point of view. If compared to territory, it is essential for the existence of the state. Due to its irreplaceable character in life development, not only human life, this resource deserves special protection and in that sense the law occupies a significant place for its integrative, organizational, legitimizing functions, and conflict resolution, It should be able to promote legal instruments with sufficient updating, objectivity and flexibility to adapt to changing circumstances in each country. The laws and planning instruments which regulate the use of soil should have an integrated character, according to the social function of property right and at the same time to facilitate an adequate territory management, with a proper attention to environmental issues. Assessing the legal dimension of territorial order and its influence in an adequate soil usage as a natural resource is the objective of this work.
