With the objective of analyzing the importance of judicial and criminal investigation to determine the veracity of the crime, a descriptive research was carried out of a bibliographic review type, with a qualitative approach, based on hermeneutical, exegetical, content analysis and synthetic-analytic methods. The inquiries made allowed to establish that a judicial and criminal investigation not coherent and lack of rigor, causes errors to be made when relating in the expert report the legally relevant facts, which limits its accuracy, causing the consequent inconsistency in the performance of criminal judicial praxis; the non-specification of the factual framework of the accusation and the accusation generate difficulties when defining the subject of the evidence, and, consequently, also at the moment of motivating the judgment, which may lead to violation of the right to defense or lead to impunity; hence its importance to determine the veracity of the crime.
