Education is an original right to the condition of the human being, because from it the bond of belonging to society is built. Jail is the place where those people who, for the most part, have not had education, work, health and any type of guarantees end up. It is education in general, and especially in prisons, which acts as a safeguard for the condition of human beings for those who have committed crimes. Therefore, imprisonment, even if it is considered a justified punishment, should not entail an additional deprivation of rights, since the only right that is deprived when being detained is freedom of movement. The problem of penitentiary transfers generates serious inconveniences in the sphere of penal execution; among them, the education of the prisoner, as a constitutional right that assists him. It becomes necessary to establish objective parameters that contribute to the formulation of an educational policy that is more consistent with the rights protected by the Constitution of the Republic. With the methodical revision of the conventional and constitutional parameters, it is possible to elaborate contributions for the construction of a better penitentiary educational policy and the implications of the transfers.
