This research aims to establish the dimensional components of the right to primary education, making an approach to the responsibility of the State, family and society, as partners in the comprehensive development of boys and girls in Ecuadorian territory. The text problematizes the difficulties that education faces around the budget and accessibility as one of the greatest state responsibilities, also the situation of early childhood is analyzed in the light of the different normative bodies, contrasting health and education as rights of equal hierarchy. that are in conflict during the current health crisis. Methodologically, a systematic review of various research articles indexed in scientific journals was carried out, as well as the national and international regulatory precepts that led to the consolidation of qualitative research. Among the main conclusions, it is established that it is necessary to strengthen the educational system adapted to the new digital age in order to preserve cognitive and comprehensive development in children, avoiding undermining education for the benefit of health as fundamental rights.
