The educational formation is fundamental in every human being, much more in the university formative process, which has as a priority the development of research, everything will depend on the performance of each student. That is why this research work seeks the need for a new conception in university training approaches, mainly for the effective enforcement of preventive imprisonment. In Ecuador it is excessively applied despite not being the only one. The objective of this work is to analyze the degree of knowledge that legal professionals have about pretrial detention as a precautionary measure in flagrant crimes. Analytical, historical, and qualitative-quantitative methods were used, as well as a survey and a questionnaire of questions through virtual platforms to obtain the information. The results indicated that the preventive measure of pretrial detention is not used as a last resort in flagrante delicto, but rather as a first alternative.
