VALDES-MIRANDA FERNANDEZ, Elizabeth y GAMEZ GRANDA, Gabriela. A Look from Public International Law to the Impact for Cuba of the Regulation of State Immunity in the United States. UH [online]. 2022, n.293 Epub 11-Mayo-2022. ISSN 0253-9276.
The regime of sovereign immunities of States has two expressions: immunity from jurisdiction and immunity from execution. The general rule of this regime is that no State may be tried in the national courts of other States, with certain exceptions. The objective of this research is to analyze the behavior of the law of sovereign immunities of States in U.S. legislation and practice in order to assess its effects on Cuba's interests, taking into account that the judicial decisions under the U.S. Sovereign Immunities Act in which Cuba has been involved demonstrate political manipulation, incompatibility of the assumptions of application of the law and violations of general principles of international law.
Palabras clave : execution; jurisdiction; terrorism.
