In order to analyze the presumed death by disappearance concept in the Ecuadorian legislation, a descriptive study with a quantitative approach was developed, systematized by scientific research methods: exegetical, hermeneutic, content analysis, analytical-synthetic and statistical. The survey applied allowed to determine that the Ecuadorian legislation regulates the provisions on presumed death; but the regulated times for the declaration of this institution are not adequate in the current social circumstances mediated by Information and Communication Technologies (ICT), in addition there is ambiguity in the use of the terms "absent" and "disappeared"; which corresponds to the criteria of the professionals of the Legal Sciences surveyed.
