Public Procurement is a procedure implemented in democratic States for the acquisition or lease of goods, execution of works and provision of services, be these professionals, technical, operational and even those related to consulting, applicable to all entities belonging to the administration. public, that is, no institution or body of the public sector is free from the public procurement procedure; however, in public companies, that procedure regulated by law does not apply. The objective of the investigation is to carry out a study of the corruption of public contracting by the procedures used in public companies, which are directly and even permissible the design of contracting by the highest authorities of those companies. The research will be qualitative, with a descriptive and explanatory scope, accompanied by the legal hermeneutical method, to indicate how corruption operates and what are the causes that allow such conduct within public procurement in public companies. Regarding the study population, the contracts made by the Public Companies of the Municipal GAD of Quevedo in times of confinement were taken as the object of study. It was obtained as a result that the public contracting practiced within public companies, follow a design issued by the highest authorities and those with whom they practice an agreement or strategic alliance, therefore, corruption in public contracting is not only in the overpricing that has always been questioned, but in its direction and the flexibility of contracting with public companies.
