The article deals with historical elements of the emergence of tourism, analyze the legislative pronouncement as an autonomous discipline within the national legal system and point out some legal gaps that remain in the norm from the modifications and updates to the regulatory framework, taking into account taking into account the diversity of economic actors that are articulated in tourism development. The main branches of law that are linked to tourist activity are determined, since tourism and its economic activities in Cuba have become a social phenomenon and turning the sector into a strategic ruble for the national economy. It raises the need to establish an administrative model and legal regime applied to economic actors in the tourism sector that guarantee national chaining and insertion in Global Tourism Value Chains, aimed at developing a regulatory framework in accordance with legal criteria. international and country needs. The high importance and pertinence in the current context of the country is highlighted, of the study of the regulatory framework associated with tourism activity, presenting as the main conclusion, the existence of legal gaps in the regulation of Tourist-Provider-State relations.
