The Obama Administration implemented executive orders and public laws aimed at regulating the role of an open government. Despite not being comprehensive enough they are considered a turning point in history. Relevant was the FOIA Improvement Act of 2016 (PL 114-185). Therefore, to establish its scope and explain its challenges during the Trump Administration was the purpose of this article. We use the systemic perspective, the bibliographic method, the qualitative content analysis to official documents of the American government as well as the comparative method. The conclusion was that the scope of the Act was marked by the technological change implemented by the 1996 E-FOIA Act although some gaps were either kept or introduced. They lead to some discretionary interpretations of the law. Among the challenges are the political context in which it is apply, the lack of political will of the President, administrative measures, cultural delay and reduced staff.
