The scientific-technical advance of the last decades in the field of life sciences requires an order from the law that integrates the fundamental postulates of Law and Bioethics, taking into account the particularities of the subject matter of regulation. The coherent ordering of procedures and results of bioscientific growth requires the determination of a set of foundations that contribute to the harmonious conception of a particular legal subsystem that orders the results of the increasingly vertiginous biomedical and scientific growth in Cuba. This process must start from the identification of principles, values and rights recognized in the Magna Carta of 2019, which structure and at the same time nurture this branch of Law, based on the founding function of the Constitution with respect to the legal system, with the objective to provide greater protection to citizens who intervene in bioscientific processes.
