Traditional knowledge in the agricultural sector lacks theoretical and legal bases to its protection in Cuba, this situation could be prejudicial to the society and people who possesses them. In fact, the objective was to establish the bases. The methods used were, legal-comparative, legal-analytic and the bibliographic analysis. The results were the contrast between different protection systems, the analysis of advantages and disadvantages of ways of protection, the theoretical- legal bases to the future regulation and consulting bibliography.  From this methodology, a correct definition will allow the law adaptation to guarantee any kind of protection and the appreciation of the agricultural work
