Indigenous communities have rules for the application of sanctions to members of their community in case of violation of the general rules of coexistence. Having an intercultural legal system leads to the resolution of conflicts within their own worldview, whose sanctions have a social purpose and the effective reparation to the victims. However, jurisprudence has been established from the resolution of the Constitutional Court that determines that any case that attempts against the lives of people whose actors belong to any indigenous community, the competence to know, resolve and sanction is exclusive and excluding faculty of the Ordinary Criminal Law System. On the other hand, intercultural education is the proposal of an inclusive education that promotes knowledge and cultural exchange as a positive valuation of cultural diversity in terms of coexistence, curricular innovation and promotion of intercultural education.The present research aims to develop a method for the evaluation and decision in the application of the principle of interculturality through the Analytical Hierarchical Process. The proposal is implemented in the province of Pastaza from which is achieved as a result the decision making for the appropriate sanction with the application of the principle of interculturality in justice and education.
