With the objective of analysing the legal figure of the inexcusable error in the Ecuadorian legislative context, a descriptive study was developed of type bibliographic review, with a quantitative-qualitative approach, systematized by means of scientific research methods: exegetical, hermeneutic, analytical, synthetic and statistical-. The results obtained allowed to determine that the legal figure of the inexcusable error has been a topic of reflection and controversy in recent times, there are conflicting criteria on the part of jurists, some advocate its inclusion in the legal system, others for its exclusion; but what is a reality is the need to eliminate the gap in the law and regulate the organ suitable to establish and sanction it.
