This article responds to a descriptive study of the literature review type that aims to argue about some considerations of treatment in the Code of Children and Adolescents on the right to education; The methodology adopted was based on exegetical and hermeneutical methods. Among the main findings are the existence of a normative framework on intercultural education and as part of this the code under study that should be reviewed and refined in aspects such as, the particularities of intercultural bilingual education, initial education, primary education, continuity of studies in secondary education, treatment of internal migrants to urban areas.
