Abstract

At present, most Latin American laws consider procedural requirements as indispensable requirements; without these requirements, the reciprocal relationship between rights and obligations cannot be established, that is, an effective procedural relationship. This article analyzes the procedural and material assumptions in Ecuadorian Civil Procedural Law from the perspective of the General Organic Code of Processes, prerequisites for the establishment of a procedural legal relationship, since it is necessary for the court to verify whether certain assumptions are met. to establish a valid process that guarantees due process and respects substantial solemnities. In addition, an assessment is made of the elements that affect them from the training of future lawyers.
