This article analyzes the procedural and material assumptions in Ecuadorian Civil Procedural Law from the perspective of the General Organic Code of Processes, prerequisites for the establishment of a procedural legal relationship, since it is necessary for the court to verify whether certain assumptions are met. to establish a valid process that guarantees due process and respects substantial solemnities. In addition, an assessment is made of the elements that affect them from the training of future lawyers.
