The work addresses the crisis that the educational system is going through in our country as a consequence of the medical emergency COVID 19; and its economic repercussion, in the rural sectors of the Province of Chimborazo; we will legally analyze the violation of the Right to education, as well as the influence of economic resources that prevent children from accessing technological equipment to develop in the new virtual modality implemented by the National Government; With the application of the inductive, synthetic analytical, historical-logical, bibliographical and exegetical methods, it was possible to determine the transgression of fundamental rights such as education, a right enshrined in the Constitution of the Republic of Ecuador and International Treaties; it was also established that most families in the rural sector do not have internet signal, nor economic resources to acquire technological equipment to receive virtual classes on equal terms, as established in the Constitution.
