The work initially addresses the characterization of the civil liability system, as it has been conceived from the nineteenth century law at the codification stage, transcending the approach of the difficulties faced by civil liability for environmental damage from the postulates of the legal sciences. Through comparative law we analyze and summarize different positions of international legal bodies in order to approach a legal reasoning that contributes to continue perfecting this important matter, on which depends the protection of the environment and therefore the maintenance of human life.
