El artículo aborda el tratamiento del Derecho Penal ambiental a la protección de estos ecosistemas, en respuesta aun sin la eficacia requerida a la preocupación internacional por los problemas medioambientales y la desconexión real entre la protección, los beneficios que proporcionan los ecosistemas y la manera irracional de actuación del ser humano ante la naturaleza. Como métodos fundamentales se utilizan el exegético-analítico, para determinar el sentido y alcance de las normativas vigentes en la materia, en conjunción con las instituciones jurídicas relacionadas con el tema, para lo cual se evaluará la validez y eficacia de la normativa vigente sobre la materia; el doctrinal en correlación con el análisis de la legislación vigente, para verificar la necesidad de su perfeccionamiento; el histórico, para abundar en los antecedentes, el contexto y formación de las doctrinas normativas y iusfilosóficas que le sirven de fundamento; y finalmente el de Derecho Comparado, que permitió conocer el tratamiento jurídico que dan otros sistemas de Derecho a una realidad similar y valorar críticamente si amerita una toma de referencia para los propósitos de esta investigación.

The article addresses the treatment of environmental criminal law to the protection of these ecosystems, in response even without the required effectiveness to the international concern for environmental problems and the real disconnection between protection, the benefits provided by ecosystems and the irrational way of action of the human being before nature. As fundamental methods, the exegetical-analytical method is used to determine the meaning and scope of the regulations in force in this area, in conjunction with the legal institutions related to the subject, for which the validity and effectiveness of the current regulations on the matter; the doctrinal in correlation with the analysis of the current legislation, to verify the need for its improvement; the historical one, to abound in the antecedents, the context and formation of the normative and iusophosophical doctrines that serve as its foundation; and finally that of Comparative Law, which allowed us to know the legal treatment given by other systems of Law to a similar reality and to assess critically if it merits a reference point for the purposes of this investigation.
