El artículo realiza un análisis normativo (constitucional y legal), doctrinario y jurisprudencial sobre el sistema del libre despido en la legislación laboral ecuatoriana, examinando sus falencias, a fin de establecer los fundamentos necesarios para la implementación del sistema del libre despido, en concordancia con unas de las metas de la Agenda 2030 en su objetivo No 8: el Proteger los derechos laborales y promover un entorno de trabajo seguro y sin riesgos para todos los trabajadores. Como métodos fundamentales utilizamos el analítico, para determinar el el orden, sentido y alcance de las normativas vigentes en la materia, en conjunción con las instituciones jurídicas relacionadas con el tema, para lo cual se evaluará la validez y eficacia de la normativa vigente sobre la materia; el doctrinal en correlación con el análisis de la legislación vigente, para verificar la necesidad de su perfeccionamiento y el histórico, para abundar en los antecedentes, el contexto y formación de las doctrinas normativas que le sirven de fundamento.

The article performs a normative (constitutional and legal), doctrinal and jurisprudential analysis on the system of free dismissal in the Ecuadorian labor legislation, examining its shortcomings, in order to establish the necessary foundations for the implementation of the free dismissal system, in agreement with one of the goals of Agenda 2030 in its objective No 8: Protecting labor rights and promoting a safe and safe working environment for all workers. As fundamental methods we use the analytical method to determine the order, meaning and scope of the regulations in force in conjunction with the legal institutions related to the subject, for which the validity and effectiveness of the current legislation on the matter; the doctrine in correlation with the analysis of the current legislation, to verify the need for its improvement and the historical, to abound in the background, context and formation of normative doctrines that serve as a foundation.
