La acción como categoría del delito constituye su más importante elemento. Interesan al derecho penal solo las acciones humanas penalmente relevantes, aquellas que son expresiones de la voluntad y que producen un resultado socialmente no querido. La acción se constituye de este modo en un límite de aplicación de la teoría del delito, puesto que se debe descartar de su estudio toda expresión o participación del ser humano en que no haya existido voluntad. Toda acción implica necesariamente la determinación de un propósito, meta o fin; pensar de otra manera sería apreciar el mundo de forma ciega ya que es imposible una actuación sin finalidad. La acción, se desarrolla así, en la mente humana con la proposición de esta finalidad, y posteriormente se pone de manifiesto en el mundo objetivo.

Action as the category of crime constitutes its most important element. Criminal law is only concerned with human actions that are criminally relevant, those that are expressions of the will and that produce a socially unwanted result. The action constitutes in this way in a limit of application of the theory of the crime, since it must be discarded of its study any expression or participation of the human being in which there has been no will. Every action necessarily implies the determination of a purpose, goal or end; to think otherwise would be to appreciate the world in a blind way since it is impossible to act without purpose. Action thus develops in the human mind with the proposition of this purpose, and subsequently becomes manifest in the objective world.
