The article deals with the problem arising from insufficiently legally regulated issues of illegal currency transactions. When writing the article considered the materials of judicial practice. As a result of the analysis, it can be assumed that currency transactions are the main part of a developed financial market. Russia's highly efficient economy is impossible without a developed financial market, the main part of which is the foreign exchange market and foreign exchange operations conducted on it. The federal law of December 10, 2003 No. 173-FZ “On Currency Regulation and Currency Control” reorganizes the mechanism of currency regulation and currency control in our country. Based on the analysis, it can be concluded that the development of the currency regulation and currency control system depends on the financial and investment climate of the country.
