This paper deals with an analysis of the evidentiary responsibility of the procedural parties in a disciplinary and administrative proceeding, by reviewing the scope of three administrative regulations of public institutions that are unrelated to each other, which regulate the flow of the investigation. It concludes that the need to incorporate principles of Criminal Law such as objectivity and innocence in the approach of Ecuadorian Disciplinary Law to appease the violation of rights.
