The issue of raciality has sparked a debate within the field of legal research, however, its complexity requires a detailed study of the anthropological and sociological roots that conditioned it, and the causes at the level of collective representation that make it still manifest. in our daily life. The range of the reflection of racial prejudice is wide from the macro-social to the most everyday, taking collective representations and their transdisciplinary legal anthropological interrelation as an articulating axis, a conceptual analysis is proposed to reveal the implicit and explicit causes of the type of remnants of racial prejudice. The fact that the definition of the term discrimination refers to policies and practices that harm a group and its members and can be de facto (practiced but not legally decreed) or de jure (part of the legality) place this element within disciplinary boundaries of Law, Anthropology and Sociology. The management of obsolete and reductionist concepts does not allow to face the scourge of racism with objectivity, thus the corpus of fictional concepts of anthropology are key to the technical-instrumental rationality of legal sciences.
