Abstract

In the present work, a comparative study was carried out analyzing the different factors in the treatment given by the legal systems of Venezuela and Ecuador to the classification and punishment of the illicit association to commit a crime in their fight against organized crime. The research was approached from a qualitative approach with a cross-sectional design, based on the analysis of legal instruments and the application of in-depth interviews. Given this, it could be concluded that the Ecuadorian legislative strategy is wrong compared to a Venezuelan legal system that is based on pillars of the international legal framework, which allows a contextualization and correct treatment of this type of organized crime.
