Abstract

VALVERDE TORRES, Yanhet Lucia  and  ANDRADE SALAZAR, Oswaldo Liber. The right to digital disconnection of workers: an analysis from the perspective of experts in Ecuador. Universidad y Sociedad [online]. 2023, vol.15, n.6, pp. 479-490.  Epub Dec 10, 2023. ISSN 2218-3620.

In the digital era, where technology has enabled greater interconnection, workers face new challenges related to disconnection from their work activities. Digital disconnection refers to the right of workers to be permanently unavailable or connected through electronic devices outside their working hours. Although digital disconnection has not been explicitly recognized in many legal systems, its importance and relevance in the current labor context justify a reflection from a labor law perspective. The objective of this study is to compile the opinions, analysis and recommendations of Ecuadorian experts regarding the right to digital disconnection of workers in Ecuador. It was developed under the qualitative paradigm, based on the application of the Delphi method of expert consultation. Eleven experts related to labor law and labor legislation were consulted. Aspects such as the legislation in force in the country, the effects on the health and welfare of workers, and the prospects for implementation of the right to digital disconnection were examined. The results of this study support the need to expand the scope of digital disconnection as a right of all workers in Ecuador and to make changes in the current legislation.
