The aim of this study was to examine the relevance of conciliation in conflict resolution in the criminal justice system in Ecuador, specifically in cases classified as crimes and punishable by prison sentences of more than 5 years. The research was carried out in the canton of Santo Domingo during the second semester of 2021 and the first semester of 2022. For this purpose, a qualitative-quantitative approach and a non-experimental cross-sectional design were used. Analytical-synthetic, deductive and historical-logical methods were used, as well as documentary analysis, interviews and surveys. The results obtained showed the need to reform the Organic Integral Penal Code with the aim of expanding the use of conciliation. This reform would avoid the unnecessary exhaustion of state resources and the excessive use of the Ius Puniendi. It is also expected that this reform will contribute to address the problems arising from overcrowding in prisons.
