The purpose of this research work is to analyze the responsibility of the Ecuadorian State in the right of repetition when there are cases of malice or gross negligence on the part of public servants in the performance of their duties, as well as on the part of individuals. A descriptive approach with a qualitative perspective will be used, based on the exegetical methods, documentary and bibliographic review, and the technique of content analysis. This approach will allow us to identify the causes that generate the responsibility of the State, either by actions or omissions of public servants in the exercise of their functions, which may lead to the violation of rights and the need to repair the damage caused. This responsibility of the State covers the civil, administrative and criminal spheres, and must be assumed by the State to remedy the damages caused to the affected individuals.
