Necesidad de la implementación del Sistema Interno de Propiedad Intelectual en las ciencias médicas

EDITORIAL
En la actualidad se vive en un mundo marcado por el vertiginoso avance tecnológico y el incremento de las redes sociales; esta compleja dinámica que desarrolla la sociedad cubana, impone desafíos en el Sistema Interno de Propiedad Intelectual como soporte en la gestión del conocimiento.
La gestión del conocimiento constituye un nuevo enfoque gerencial, que utiliza el recurso humano y su conocimiento en función del desarrollo de entidades y empresas. La innovación tecnológica, como una de las vertientes de estos saberes, se encuentra entre los factores que contribuyen al aumento de la productividad y el crecimiento económico sostenido, sin embargo, los resultados de la innovación requieren de protección jurídica diseñada en la Propiedad Intelectual 1.
La propiedad intelectual se divide en dos modalidades: la propiedad industrial y el derecho de autor, la primera se rige por la Oficina Cubana de Propiedad Industrial (OCPI) del Ministerio de Ciencia Tecnología y Medio Ambiente (CITMA), se refiere a los derechos que se adquieren por la creación de invenciones y diseños industriales, topografías de circuitos integrados, así como marcas y signos distintivos, servicios de marcas, nombres y denominaciones comerciales, denominaciones de origen, indicaciones geográficas y secretos empresariales. El derecho de autor, o copyright, lo implementó el Centro Nacional de Derecho de Autor (CENDA), del Ministerio de Cultura, se encarga de regular los derechos de los autores sobre sus creaciones individuales, específicamente creaciones artísticas, científicas, literarias y educacionales de carácter original como resultado de su actividad intelectual 2-4.
A partir del año 2002 el CITMA emite la Resolución 21 donde el Sistema Nacional de Propiedad Industrial de la República de Cuba es el responsable de diseñar y organizar nuevas conductas y modos de planificar la labor administrativa. La propiedad industrial y su utilización tengan significado y trascendencia al trazar los lineamientos comunes que deben regir las acciones de los actores sociales, tanto en su acontecer interno como en su interrelación con otros actores a fin de lograr su estructura e implementación 5.
En la era de las tecnologías de la información y las comunicaciones (TICs), es imprescindible el fortalecimiento de las bases legales de la Propiedad Intelectual en todas sus tipologías, y su aplicación estricta para la protección de los bienes intangibles, donde ocupa un lugar importante el conocimiento científico.
A pesar de la existencia de la Resolución 21 del CITMA en Cuba aún es insuficiente la cultura sobre la protección y legislación de la propiedad intelectual entre los creadores y organismos como el Ministerio de Salud Pública.
Los estudiosos del tema afirman que por concepto de patentes y licencias se pierden innumerables ganancias, las patentes solicitadas pudieran ser mayores y los avances científico-tecnológicos mucho más significativos.
]]> En las ciencias médicas es frecuente la generación de guías prácticas, flujogramas, algoritmos de diagnóstico y tratamiento, índices pronósticos y escalas predictivas; estos resultados científicos requieren de su protección por los autores, lo que le concede un derecho exclusivo para impedir que terceros, sin su consentimiento, realicen actos de fabricación, uso, venta o importación. No obstante el creador tiene el derecho de cederlas o transferirlas por sucesión y de concertar contratos de licencia a quienes deseen.En los centros de educación médica el diseño y evaluación de medios de enseñanza (las multimedias, hiperentornos de enseñanza-aprendizaje, las maquetas o simuladores…) es una vía frecuente para contribuir a perfeccionar el proceso de enseñanza-aprendizaje, lo cual necesita también de esta protección.
Si los estudiantes, técnicos y profesionales de la salud ampliaran la cultura respecto al tema de la propiedad intelectual y la innovación tecnológica adaptadas a las exigencias de las TICs se lograría obtener ingresos adicionales procedentes de la concesión de una licencia sobre la patente o de su cesión, aumentar el acceso a la tecnología mediante la concesión de licencias cruzadas, reducir los riesgos de infracción, aumentar la capacidad de obtener capital para poner un producto en el mercado y ofrecer una imagen positiva de la institución de salud 6,7.
Por la importancia que representa la implementación de la propiedad intelectual se hace necesario la creación de sistemas internos en cada institución de salud que garantice la correcta y acertada organización de esta actividad.

Nowadays, people are living in a world marked by rapid technological advances and by the increase of social networks; this complex dynamics the Cuban society is developing, imposes challenges to the Internal System of Intellectual Property as support for the management of knowledge.
Management of knowledge constitutes a new approach that uses human resources and their knowledge towards the development of entities and enterprises. Technological innovation, as a trend of knowledge, is one of the factors that contribute to the increase of productivity and to the sustained economical growing. Nevertheless, the results of innovation require judge protection designed in Intellectual Property 1.
Intellectual property is divided into two modalities: industrial property and author’s right, the first is guided by the Cuban Office of Industrial Property, belonging to the Ministry of Science, Technology and Environment, it is referred to the rights acquired by clients for the creation of inventions and industrial designs, topographies of integrated circuits as well as marks and distinctive signs, marks services, names and origin and commercial denominations, geographical indications and enterprises secrets. Author’s rights or copyright was implemented by the National Centre of Author’s Rights, belonging to the Ministry of Culture whose main goal is to regulate the rights of authors over their original artistic, scientific, literary and educational creations as result of their intellectual activity2-4.
From 2002, the Ministry of Science, Technology and Environment dictated the 21 resolution stating that the national system of Industrial Property of the Cuban Republic is the responsible of designing and organizing new behaviors and ways to plan administrative work, in a way that Industrial property and its uses have meaning and transcendence when tracing the common statements that can follow the actions of social doers in their internal fulfillment as well as in their relationship with others to institute structure and implementation 5.
In times of information and communication technologies, it is vital the strengthening of legal basis in terms of Intellectual property and its different types and also in its strict application of the protection of resources in which scientific knowledge plays an important role.
]]> In spite of 21 resolution, in Cuba, it is still not enough the culture of protection and the legislation of intellectual property between creators and organizations as the Ministry of Public Health.Researchers of this topic assure that due to the concept by patents and licenses, uncountable profits are lost, solicited patents could by greater and scientific and technical advances more significant.
In medical sciences, it the generation of practical guides, flujograms, diagnostic and treatment algorithms, prognostic indexes and predictive scores becomes frequent; these scientific results need their protection by the authors what gives them an exclusive right. Nevertheless the creators have the right to give and transfer the rights by succession and of agreeing license contracts to the ones interested in these products.
In medical education centers, the design and evaluation of material aids become a frequent way to contribute to improve the teaching learning process what also needs the protection mentioned.
If health technical and professional students enlarged their culture towards the topic of intellectual property and technological innovation, adapted to the demands of informatics, they could obtain additional incomes coming from licenses about patents, they could increase the access to technology and could reduce the risks of contravention, they could also increase the capacity to obtain income to put a product in the market and to offer a positive image of the health institution they belong to 6,7.
Due to the importance of the implementation of intellectual property, it is necessary the creation of internal systems in each health institution that guarantee the correct organization of this activity.
