ABSTRACT
The present work consists in analyzing the unconstitutionality in the defense of the process within a direct procedure in the flagrant crimes, considering that Ecuador is a constitutional State of rights and justice, for that reason the judge or judges must guarantee a right to the defense of people, when considering different scenarios that merit some kind of corrections, without violating the fundamental principles established in the constitution, as well as stipulated in the universal declaration of man, which are the fundamental bases to be able to develop properly, the processes judicial and establish responsibilities for the conduct of the accused, applying an effective, impartial and expeditious guardianship of their rights and interests, giving legal certainty at the time of application of the regulations.
