Abstract

The activity of the Courts of Justice constitutes a prior and necessary presence in the judicial system at the time of administering justice in a criminal proceeding: the procedural capacity, the legitimacy of its members, the precedence, the jurisdiction and the competence. These assumptions must be closely related to certain principles of criminal procedure law in order to achieve due process, i.e. a process in which the established procedural guarantees are materialized, a situation that gave rise to the investigation whose problem to be solved is: How should the assumptions of the activity of the courts of justice be expressed in order to achieve due process? In line with this problem, the objective is to establish the basis for the assumptions of the Tribunals' activities, based on their relationship with certain principles of criminal procedure in order to achieve due process. This topic has a great level of application and impact since it offers students and professionals of the Law an important tool for consultation that allows them to base doctrinal and legal questions that the Courts of Justice must take into account during the processing of a criminal process to guarantee a due process.
