Abstract

LAGUNA DELGADO, Harold Esteban; MENDEZ CABRITA, Carmen Marina; PUETATE PAUCAR, Jairo Mauricio  and  ALVAREZ TAPIA, Milena Elizabeth. Origin and evolution of legal pluralism in Latin America, as a critical vision from the perspective of comparative law. Universidad y Sociedad [online]. 2020, vol.12, n.5, pp. 381-388.  Epub Oct 02, 2020. ISSN 2218-3620.

The article proposes a critical view of Ecuadorian legal pluralism, in light of comparative law, which assumes the coexistence of two or more normative orders. The importance of this documentary research lies in the need to deepen the study of legal pluralism, through the philosophical, hermeneutic and bibliographic analysis of the different theoretical contents, aiming to identify the different doctrinal contributions of the representatives of the different theoretical currents of legal pluralism in Latin America, with the purpose of conceptually enriching Ecuadorian legal pluralism. Based on the information collected, the aim is to analyze whether there is an effective application of legal pluralism in Ecuador, compared to the models established in Latin America, and thus assess the need to optimize Ecuadorian pluralism as an alternative model of law.

Keywords : Legal Pluralism; indigenous justice; ordinary justice; plurinational state; comparative law.
