Abstract

GUZMAN HERNANDEZ, Yan. Implications of the right to adequate housing in Cuba as of the 2019 Constitution. UH [online]. 2022, n.294  Epub June 01, 2022. ISSN 0253-9276.

The reform of the Constitution in Cuba in 2019 had a positive impact on the plexus of rights, one of the most favored was the right to housing, since its regulation in article 71 tends to its enforceability and the term “adequate”, in line with international instruments. The new formulation, together with other constitutional precepts that contribute to its realization, require a broader and more contextual interpretation of this right. Hence, the purpose of this work is to contribute to determine the scope and content of the right to adequate housing in Cuba, as well as to establish the new legal position of the State and citizens regarding it.

Keywords : right; adequate housing; international instruments; social rights; Constitution..
