Abstract

In this article, he made a brief study on the subject: the right to Effective Judicial Protection and the relation with the Principle of Inmediation in the Ecuadorian Civil Oral Process, the same that is born taking into account the changes within the civil process, implemented to from COGEP approval in Ecuador. The research aims to establish the legal effects of the effective implementation of the principle of immediacy and concentration in the Ecuadorian civil oral procedure, with a view to comply with the guarantees of the framework of good living. Thus, the methodology of the bibliographic review was applied, outlining concepts of the right to effective judicial protection, and the need for its correct implementation in the judicial system is exposed, which not only entailed the level of administration of justice ; but also in the conceptualization of the process as a means to adequately protect the rights of individuals. The main characteristics and their relation to the principle of immediacy and concentration in the civil oral process were analyzed, as a consequence of the different causes that congestion the civil procedural system in our country, and that therefore they did not allow that the constitutional guarantee was fulfilled of the effective protection of justice with speed and procedural economy to which all persons are entitled.
