This paper analyzes the type of contract relevant to vital food as an alternative to find the elders care needs management as a way to prevent their physical and mental capacity deterioration. In Cuba, this is a question is dealt with through Law, by means of other patrimonial dispositions, such as the will and donation, or through family institutions such as guardianship and the legal obligation of providing food. This situation results insufficient due to the accelerated aging of the Cuban society. The overall objective of this research is to determine the legal viability for the implementation of the contract focused in providing vital food in the Cuban context. The research has been structured into two parts. In the first part the authors establish the conceptual elements of the contractual figure object of study, and the second part is dedicated to the support of the possibilities existing in Cuba for the reception of the food contracts, including a notarial writing preform, getting into some conclusions that synthetize the study results.
