Abstract

Article 11 of the Cuban Constitution proclaims the sovereignty of the State over the national territory and the natural resources situated, beyond its territory, in the Exclusive Economic Zone. In that senses, in this paper some lexical and epistemological juridical reflections are made about the concept of sovereignty and its relation with the Exclusive Economic Zone. It is concluded that, despite the polysemy and the synonymy with which it is currently used as a political-juridical term, sovereignty has expressly a territorial character in the Law of the Sea, therefore, it is not applicable in the Exclusive Economic Zone. Accordingly, it is suggested to correct the mentioned article in accordance with International Law.
