This article aims to socialize knowledge about the criminal process, its principles and rules, prior investigation as a pre-procedural phase, and the powers of the Prosecutor as the holder of the criminal action. It is based on a qualitative methodological strategy through which a variety of procedures and techniques are used for the collection of information, with a predominance of the bibliographical and documentary review, the historical-logical and synthetic analytical methods, to specify analysis that allow obtaining as a result, the socialization of reflections, explanations and arguments about the legality of the criminal process provided that the acts provided by the Constitution and the Codes that establish the notification to the prosecution of the beginning of the previous inquiry, regardless of the investigation reserve are fulfilled, guaranteeing the due process.
