The general purpose of this scientific article was to carry out a socio-legal analysis on the operation of the Ecuadorian prison system, it was an analytical and descriptive investigation under the qualitative modality based on the interpretive paradigm, addressing a documentary and bibliographic design, the hermeneutic method and in-depth interviews, typical of the grounded theory, concluding that there is a systematic violation of the guarantees inherent to human rights that all those deprived of liberty possess by virtue of the prison overcrowding which exceeds the installed capacity, noting an absence of programs for the reintegration into society of inmates as established by current regulations, on the contrary, what operates is a criminalization of citizens who are on trial or convicted.
