Abstract

The objective of this article is to analyze the techniques and strategies of negotiation in arbitration and mediation, the review is documentary in the area of negotiation and arbitration and mediation. There are techniques, which are used according to the type of negotiator, in the alternative means of conflict resolution. The type of research: documentary-descriptive, bibliographic documentary design, non-experimental transversal, techniques: documentary observation and legal hermeneutics. Tactics are presented, which allow the negotiator to implement strategies that lead him to achieve the proposed objectives. It is concluded that individuals have basic knowledge in negotiation, where personal experience influences to reach the resolution of controversies, this shows the need to put them into practice.
