The Internet has opened up enormous possibilities for companies to communicate their brand messages. However, its global reach, its openness, its flexibility and the fact that it is not, in a certain way, regulated, has fertilized a fertile ground for the misuse of trademarks, and all that this entails. The investigation aims to see the improper use of trademarks of commercial companies on digital platforms as criminal offenses that limit the exercise of economic activities, since it generates distrust in e-commerce, violates the rights of those who hold ownership of the brand, by committing the crime of electronic fraud and putting at risk the free economic exercise of companies through digital platforms. In this matter, the applicators of justice and legal professionals constantly refer to the regulations when it comes to ensuring adequate intellectual protection. To this end, it is necessary to carry out investigative work that elucidates the content of the legal regulations within the legal system. The methods used were exegetical and hermeneutical.
