Abstract

The present research work was focused on emphasizing that the claim must meet the requirements established in its article 142 of the General Organic Code of Processes (COGEP) and in case it is determined that the same is not clear or does not meet the requirements, the judge orders it to be clarified or completed; therefore, the research had the objective of legally analyzing the requirement of the claim according to numeral 7 of article 142 of the General Organic Code of Processes. The modality of the study was mixed, in this sense it has achieved to have an exploratory and descriptive scope, the methods used have been the deductive and the analytical - synthetic, having a documentary, field and experimental research, applying empirical techniques such as the survey, interview. The main result has been that the requirement of numeral 7 of article 142 of the General Organic Code of Processes has been exceeded, concluding that a clear and express norm should be stipulated, where the procedure in these cases is contemplated.
