Abstract

This research work addresses the psychological state of children and adolescents; however, it is necessary to be understand that custody is the judicial action in which the judge determines the care and protection of children and adolescents in favor of one of their parents. The objective of the work is to elaborate a document of critical legal analysis, where the importance of the right to psychological integrity of children and adolescents, as a result of the custody trial, is evidenced. The modality has been quantitative and qualitative, executing the survey and interview technique, under a documentary and field research, with an exploratory and descriptive scope; the methods used have been analytical-synthetic, deductive and exegetical. The main result has been that as a result of the tenancy trial, recurrent episodes associated with adaptive disorders such as anxiety and stress occur, as well as alterations in mood, sleep, appetite, a situation that at a legal level is related to the right to psychological integrity.
