Abstract

This research presents the ways of transferring a competence established in the legal field, especially delegation and subrogation, presented as legal alternatives, enabling an administrative body. In the case of delegation, we can notice when a superior organ grants competence to a lower organ on a temporary basis. In subrogation we notice the transfer from an inferior organ to a superior one in a temporary way, raising the level. For this it is necessary to use an investigative method, which leads us to discover which are the ways and the causes to be able to transfer a competence. After applying the necessary methods, we came to the conclusion that at the moment of transferring competences we can find several models or paradigms, which will be applied according to the indicated alternatives.
