Abstract

Within the present research work, it was chosen to analyze the right to resistance in situations of excessive severity in Ecuador, which takes the place of the general objective of the research work, on the other hand, as specific objectives it was proposed to analyze the doctrinal elements about the right to resistance, to determine the legal bases of the right to resistance in Ecuador. The methodology used was documentary and bibliographic to obtain in-depth knowledge about the right to resistance. As a result, it was determined that, if it is appropriate for those people whose human, the State has violated constitutional and legal rights, they can exercise the right of resistance provided for in Article 98 of the National Constitution. The research proposed strategies for the training of citizens and public officials of Ecuador on the right to resistance provided for in Article 98 of the Constitution. Finally, I conclude that resistance has been misinterpreted by some authors who are of the opinion that it is contrary to the spirit of the law when it is not so. Resistance has the objective that the spirit of the law is fulfilled, and it operates in those situations in which the State violates the law violating the rights of citizens.
