Abstract

GIRALT, Johannes San Miguel  and  BERMUDEZ SARGUERA, Rogelio. Predominant approaches to legal teaching and research in Latin America. Descriptive notes. Rev. Cubana Edu. Superior [online]. 2023, vol.42, n.2  Epub May 10, 2023. ISSN 0257-4314.

Legal teaching and research, like any other management inherent to the University, can be valued by the approaches applied to a given context. In this article, we consider as an objective to assess the sociological, pragmatic, positivist, doctrinal and axiological approaches, for their application to legal teaching and research, in the Latin American sphere. The analytical-synthetic methods and the system approach were used to identify the causes that drive the differences in teaching management and legal research, as well as in the structuring of the knowledge addressed, respectively. Documentary analysis was used as an empirical method. The results obtained can be seen in the description of the approaches and in the conclusive idea that the challenge of legal teaching and research in the Latin American region lies in the emphasis that should be given predominantly to the doctrinal approach, thus responding to the academy, to the complex, plural and highly communicated global context that assists it.

Keywords : axiology; comparative law; approach; legal ethics; legal research; positivism; pragmatism; sociology.
