Laws have supplemented international documents in order to preserve the cultural heritage. The research objectives of this paper are to determine their historical antecedents and the unique features of applying those laws in Havana. It begins with a review of the Hispanic colonial laws concerned with building construction and protecting buildings of cultural value. It also reviews the legal instruments that protect seminal buildings of Havana. A discussion of the characteristics and weaknesses of the Cuban laws today reveals difficulties of facing the built heritage conservation in Havana. Several aspects of the law should be revised and modified. The paper concludes with recommendations about the need for improving laws that guarantee the effective protection and conservation of the city’s built heritage.
