Since the emergence of the Labor Code in Ecuador in 1938, no relevant reforms have been carried out in the institution of untimely dismissal. This system of free dismissal continues to be preserved, without a sensible and consistent reform having been launched that responds to a legal investigation in harmony with the new Constitution of the Republic of Ecuador (2008), with the International Conventions and Treaties ratified by the country and by national legislation. This problem that concerns Babahoyo is based on the fact that there is no legal certainty in occasional service contracts described in the Organic Law of the Public Servant (LOSEP), affecting the Ecuadorian labor regulations in the preservation of the rights of the population in Canton, Babahoyo in the year 2020. In this sense, a critical legal analysis document was prepared that proves the lack of labor provisions in the Labor Code and alternatives are proposed to ensure effective compliance with the rights of the Labor Code, in addition, a strategy that involves students in preparing them for their future professional development.
