Abstract

The general objective of this article was to carry out a Socio-Legal Analysis of the criminal institution, objective imputation, and factual control in order to measure its efficiency and effectiveness. The research is analytical, with a qualitative approach, the method used is the legal hermeneutic, the results obtained were achieved thanks to the triangulation technique of the information obtained from the legal texts, and the in-depth interviews carried out with the key informants. As the main result, it was concluded that the objective imputation is the starting point of the criminal process since the criminal acts allegedly committed and attributed through the formulation of charges generate all the investigative scaffolding by the holder of the criminal activity.
