Abstract

The objective of this research is to carry out a contextual diagnosis in the city of Loja-Ecuador, of the legal and regulatory support for the democratic exercise of communication rights, which is given by the existence and formulation of the Organic Law of Communication and the Organic Law of Citizen Participation. The theoretical starting point was the reflection of the law and the vision of authors such as Martín Barbero, Burch, Vidal and others, which helped to understand citizens' rights to communication and citizen participation. The methodology used, of a qualitative nature, was descriptive, of critical reflection that provided an understanding of the object of study. Finally, in the results and conclusions it was possible to contrast that there is a lack of knowledge of the law at all levels, from the political and public institutions to the citizenry, which leads to the permanent violation of the rights to communication by the former and the violation of the rights of the latter without the existence of supervisory and control institutions to account for it, which is aggravated by the non-promotion of the rights to communication, which means that this state of affairs does not change.
